Buying a home is the largest investment most people will ever make, and nothing is as devastating as discovering that your new home was not built to withstand the elements of nature such as wind, rain, heat or cold. Many homes built today are part of a large subdivision and often a single builder develops the entire subdivision. If a problem exists in one of the homes in the development, it often exists in all or many of the homes in the development. Under California law, a home is classified as a “mass produced product” (similar in nature to a vehicle). However, unlike a vehicle, your home does not have a manufacturer’s label; and it is sometimes not easy to identify when or how your home was produced. The mystery behind the production of your home is complex and difficult to unravel, even during construction defect litigation. Often, the developer contracts with numerous subcontractors to produce or install various products. The subcontractors may even sub out some of their work to other subcontractors. It is often complicated to locate the person who is most knowledgeable about how your home was actually put together. Sometimes, developers change products (like windows) because of pricing or because they discover a problem with the original product.
Courts recognize the complexity of this construction process and utilize case management orders to help organize the discovery process (the exchange of information). Even after Statements of Work are produced by the various contractors and subcontractors in the case, it can be difficult to determine who was responsible for work and in what sequence the work was completed. The sequence process can be important in recovery in construction defect litigation.
